To use certain features of the App, you may need to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated.

4. Content Sharing and Usage

When using our Services, please uphold trust and respect for others. Geckoss promotes a community where originality and courteous behavior flourish.

"Content" refers to profile photos, photos, videos, links, emojis, locations, comments, or messages shared through our Services.

You hold the responsibility for the Content you share through our Services. This includes ensuring that you possess the rightful authorization to use the Content and that it adheres to applicable laws, regulations, and our User Agreement.

Should you share Content for which you lack the necessary rights or that breaches laws, regulations, or the User Agreement, we retain the authority to promptly remove it. No exceptions.

Our stance is unwavering against harassment, intimidation, defamation, threats, offensive content, child exploitation, sexual abuse, promotion of self-harm or suicide, infringement upon intellectual property, and other illicit activities. You maintain ownership of the Content you share through our Services. By sharing Content, you grant Geckoss a license under these conditions:

• Social Network & Chat content This pertains to Content shared exclusively with your friends, contacts, and groups within our platform. Additionally, for the purposes of security, moderation, and the proper functioning of our Services, we may access and review this Content.



• Publicly Shared Content, Ratings & Reviews This pertains to the Content you share within the Geckoss community, including ratings and reviews for movies, books, and more. By contributing, you provide us with a global, non-exclusive, royalty-free, sublicensable license to utilize, process, adapt, modify, publish, transmit, display, and distribute the Content you share. This license empowers us to manage and moderate the shared Content to uphold the quality and authenticity of ratings and reviews, while ensuring compliance with our User Agreement. Additional utilization of this Content is exclusively guided by our commitment to maintaining security, preventing misuse, and adhering to our legal obligations. This license does not include any promotional purposes.

Limitation of Liability for User-Generated Content:

Geckos shall not be held liable for the accuracy, legality, or authenticity of user-generated content shared through our Services. Users are solely responsible for their own contributions and interactions. While we strive to maintain a safe environment, we cannot guarantee the veracity of all user-generated content. By engaging with user-generated content, you acknowledge that Geckoss disclaims any liability for damages, losses, or harm arising from such content.

5. Safety

We are dedicated to fostering a secure environment for all users within our Services. However, we are unable to provide an absolute assurance of safety. This is where your involvement becomes pivotal. Through your use of the Services, you acknowledge and agree that you are bound by these Terms, which encompass our Community Guidelines and any additional policies disseminated by Geckoss. These measures are in place to safeguard the integrity and well-being of the Services.

6. Moderation

A significant portion of the content featured on our Services originates from users, publishers, and other external entities. Regardless of whether such content is publicly posted or privately shared, the sole responsibility for said content rests upon the user or entity that submitted it. While Geckoss retains the prerogative to assess, moderate, or eliminate all content showcased on the Services, it is important to note that not all content undergoes our scrutiny. Consequently, we cannot — and do not — guarantee the conformity of other users or the content they furnish through the Services with our established Terms, Community Guidelines, or other associated stipulations.

You must retain all copyright, trademark, service-mark and other proprietary notices contained in the original Material on any copy you make of the Material.  You may not reproduce, display, publicly perform, distribute, copy, download, license, modify or otherwise use the Material in any way for any public or commercial purpose without the prior written permission of Geckoss.

8. Third-Party Materials and Services

Certain Services may present, include, or render accessible content, data, information, applications, features, or resources originating from third parties ("Third-Party Materials"). These Services may also establish connections to specific third-party websites or permit the utilization of third-party services in conjunction with the aforementioned Services. Should you engage with any Third-Party Materials or third-party services facilitated through or in association with our Services (inclusive of Services collaboratively offered with said third parties), your interactions will be subject to the respective terms stipulated by the applicable third party. Neither Geckoss nor any of our affiliated entities bears responsibility or liability for the terms proposed by third parties, nor for actions undertaken in accordance with said terms.

Moreover, through your utilization of the Services, you acknowledge and assent to the fact that Geckoss holds no accountability for the assessment or evaluation of various attributes of such Third-Party Materials or third-party services. These attributes encompass, without limitation, content accuracy, comprehensiveness, availability, timeliness, validity, adherence to copyright regulations, legality, decency, quality, and all other associated aspects. We neither warrant nor endorse, and refrain from assuming or incurring any liability or responsibility, be it to you or any other individual, with regard to third-party services, Third-Party Materials, third-party websites, or any other materials, products, or services sourced from third parties.

Furthermore, it's crucial to recognize that the prices displayed in relation to third-party products or services may be outdated, irrelevant, or inaccurate. 9. Termination and Suspension

We retain the authority to temporarily or permanently suspend your account and restrict your access to our Services in cases where we have ascertained that you have disseminated Content in violation of our standards or have employed our Services in a manner that infringes upon the rights of others or fails to conform to pertinent laws, regulations, or the User Agreement.

Should you share Content that breaches our guidelines, your account may be subject to a 7-day suspension. During this period, you will be unable to partake in Content sharing or access other Content within our Services. Subsequent violations may result in a permanent suspension, leading to the discontinuation of your participation in our Services and the prohibition of creating a new account on our platform.

It is imperative to note that specific forms of Violative Content, such as Child Sexual Abuse Material (CSAM), warrant immediate and enduring suspension from our Services.

In order to safeguard the interests of all users and the integrity of our Services, we reserve the prerogative to temporarily suspend your account upon the detection of unusual activity that could potentially pose technical or security risks to you, fellow users, or our platform.

In instances of prolonged inactivity exceeding a span of two years, we will proceed with the deletion of your account. We will extend prior notification to enable you to intervene and prevent this deletion should you desire to do so.

We understand that circumstances may change, prompting decisions to part ways. You maintain the authority to terminate your account at any juncture by accessing the account settings and selecting the account deletion option.

10. Indemnification

You agree to defend, indemnify and hold harmless Geckoss, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including but not limited to attorneys’ fees, arising out of the use of any Service by you, or by anyone else using your Login Credentials.

11.Limitation Of Liability

While Geckoss uses reasonable efforts to include up to date information on the Site or Service, Geckoss makes no warranties or representations as to its accuracy, timeliness, reliability, completeness or otherwise.

GECKOSS PROVIDES THE SITE OR SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GECKOSS, ITS PARENT, PARTNERS, MEMBERS, MANAGERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, GECKOSS DOES NOT WARRANT THAT THE SITE, OR YOUR ACCESS TO OR USE OF THE SERVICE WILL (1) BE UNINTERRUPTED; (2) BE FREE FROM INACCURACIES, ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS; (3) MEET YOUR REQUIREMENTS; OR (4) OPERATE IN THE CONFIGURATION OR WITH THE HARDWARE OR SOFTWARE YOU USE. GECKOSS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS SITE OR SERVICE WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

GECKOSS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIAL, INFORMATION, SOFTWARE, FACILITIES, SERVICES OR OTHER CONTENT ON THE SITE OR ANY WEB SITES LINKED TO THE SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

GECKOSS MAKES NO WARRANTIES THAT YOUR USE OF THE MATERIALS, INFORMATION, SOFTWARE, FACILITIES, SERVICE OR OTHER CONTENT IN THE SITE OR ANY WEB SITE WILL NOT INFRINGE THE RIGHTS OF OTHERS AND GECKOSS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ERRORS OR OMISSIONS IN SUCH MATERIALS, INFORMATION, SOFTWARE, FACILITIES, SERVICE OR OTHER CONTENT OF THE SITE OR ANY OTHER WEB SITE. YOU ACKNOWLEDGE THAT IF NO FEES ARE PAID TO THE COMPANY FOR THE SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM THE COMPANY, REGARDLESS OF THE CAUSE OF ACTION. IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

12. International Access

The Site or the Service is controlled and operated by Geckoss located in the United States. Geckoss makes no representation that materials in the Site or the Service are appropriate or available for use in other locations, and access to them from territories where their contents are illegal is prohibited. Those who choose to access the Site or the Service from other locations do so on their own initiative and are responsible for compliance with applicable local laws. If you use the Geckoss website from other locations, you are responsible for compliance with applicable local laws.

13. Governing Law

The Contract, and any disputes arising out of or related hereto, will be governed exclusively by the internal laws of the State of California, without regard to its conflicts of laws rules or the United Nations Convention on the International Sale of Goods.

14. California Residents

If you are a California resident, in accordance with Cal. Civ. Code § 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112 Sacramento, CA 95834, or by telephone at (800) 952-5210.

15. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
